DIALWORKS AI PRIVACY POLICY

Website, Customer Accounts, and AI Communications Services
This Privacy Policy explains how DialWorks AI, LLC, an Arizona limited liability company (“DialWorks,” “we,” “us,” or “our”), collects, uses, discloses, and retains personal information in connection with our website, customer onboarding, accounts, managed AI communications services, recruiting appointment programs, support, and related operations (collectively, the “Services”).
This Policy applies to business customers, authorized users, website visitors, business contacts, prospects or candidates contacted through customer campaigns, and other individuals whose information we process in connection with the Services. It does not apply to a third party’s independent practices, even when its service connects with DialWorks.
Important distinction: When a DialWorks customer supplies or directs us to process prospect, candidate, recruiting, lead, CRM, calendar, or campaign information, the customer generally determines why and how that information is used. In that context, DialWorks generally acts as the customer’s service provider or processor. Requests concerning the underlying customer record may need to be directed to that customer, while DialWorks will directly honor opt-outs received through communications we operate and will assist the customer as required.
1. Our Privacy Roles
1.1 DialWorks as Business or Controller. DialWorks generally determines the purposes and means of processing information used for our own website, account administration, billing, contracting, security, support, service improvement, compliance, and business communications.
1.2 DialWorks as Service Provider or Processor. For Customer Data processed to operate a customer’s campaign, communicate with customer-selected contacts, schedule appointments, update customer systems, or provide related managed services, DialWorks generally processes information on the customer’s documented instructions and under the customer agreement. The customer remains responsible for the source, lawful basis, notices, permissions, campaign purpose, and independent use of that information.
1.3 Customer-Specific Notices. A DialWorks customer may provide its own privacy notice or disclosures. If that notice applies to a customer-controlled campaign or record, individuals should review it and contact the customer regarding its independent practices.
2. Personal Information We Collect
Depending on the relationship, campaign, integrations, and use of the Services, we may collect the following categories of personal information:
- Identifiers and contact information, such as name, business name, postal address, email address, telephone number, account identifier, and online identifiers.
- Professional, recruiting, and business information, such as brokerage, team, company, title, role, license information, market area, business affiliation, recruiting status, publicly reported production or experience information, and professional preferences.
- Customer account and contract information, such as organization, authorized users, account permissions, Customer Orders, acceptance records, document versions, billing contacts, support requests, and customer instructions.
- Payment and transaction information, such as invoices, amounts, payment status, billing address, and limited payment-method details received from our payment processor. We generally do not store complete payment-card numbers.
- Campaign and communications information, such as telephone calls, recordings, transcriptions, messages, emails, communication content, timestamps, caller or recipient numbers, call outcomes, summaries, questions, preferences, objections, opt-outs, complaints, appointments, reschedules, cancellations, and follow-up status.
- CRM, calendar, and integration information, such as contact records, notes, appointment details, event metadata, integration identifiers, synchronization status, and data made available through customer-authorized systems.
- Device, website, and usage information, such as IP address, browser and device type, operating system, referring page, pages viewed, interaction events, approximate location derived from IP address, cookies, logs, diagnostics, and security events.
- Inferences and AI-assisted classifications, such as likely interest, communication disposition, qualification status, appointment readiness, sentiment, categorization, or recommended next action generated from available information and interactions.
- Compliance and risk information, such as consent or disclosure records, do-not-call or do-not-contact status, suppression entries, opt-out source, complaint history, litigation-risk flags, fraud or abuse indicators, and records needed to demonstrate compliance.
- Other information an individual, customer, authorized integration, service provider, or public source supplies in connection with the Services.
3. Sources of Personal Information
We may obtain personal information:
- directly from customers, authorized users, website visitors, business contacts, and individuals who communicate with us or through the Services;
- from customer-provided prospect lists, CRMs, calendars, suppression files, campaign instructions, and other customer-controlled systems;
- from data providers, real-estate or professional-information sources, public records, public websites, directories, social or professional platforms, and other sources a customer or DialWorks is authorized to use;
- automatically through websites, accounts, communications systems, cookies, logs, telecommunications providers, and security tools;
- from service providers and integrations, including telephony, AI voice and transcription, hosting, CRM, calendar, email, SMS, analytics, payment, support, identity, and security providers; and
- through inferences or classifications generated from the information described above.
4. How We Use Personal Information
We may use personal information to:
- provide, configure, operate, support, monitor, and improve the Services;
- conduct customer-approved communications, identify the purpose of a campaign, respond to individuals, qualify interest, schedule or manage appointments, and update authorized customer systems;
- create accounts, authenticate users, administer Customer Orders, document electronic acceptance, process payments, invoice, and maintain business records;
- record, transcribe, summarize, classify, and analyze communications for service delivery, appointment handling, quality assurance, customer reporting, training, safety, and compliance where permitted;
- honor opt-outs, manage do-not-call and suppression controls, investigate complaints, prevent prohibited contact, and maintain compliance evidence;
- secure accounts and systems, detect abuse, prevent fraud, troubleshoot, maintain reliability, and respond to incidents;
- communicate about accounts, support, service changes, billing, security, legal matters, and relevant products or services;
- develop and improve workflows, reliability, quality, analytics, and service capabilities using operational information and aggregated or deidentified data;
- comply with law, legal process, contracts, provider requirements, and lawful requests; establish, exercise, or defend legal claims; and protect individuals, customers, DialWorks, providers, and the public; and
- perform another purpose disclosed when information is collected or authorized by the individual or customer.
5. AI, Automated Processing, and Human Decisions
The Services use artificial intelligence and automation to conduct or assist communications, transcribe and summarize interactions, classify outcomes, identify possible interest, support scheduling, update systems, and recommend operational next steps. AI-generated content and classifications may be incomplete or inaccurate and should be verified before material reliance.
DialWorks does not make final hiring, employment, affiliation, licensing, housing, credit, insurance, legal, or similarly significant decisions about individuals. Our customers make their own decisions and are responsible for any independent evaluation or action they take based on information produced through the Services.
Where applicable law provides rights concerning profiling or automated decision-making that produces legal or similarly significant effects, individuals may submit a request using the methods in Section 13. DialWorks may refer the request to the customer responsible for the relevant processing.
6. Calls, Recordings, Transcriptions, and Opt-Outs
Communications made or received through the Services may be monitored, recorded, transcribed, summarized, or analyzed for service delivery, scheduling, documentation, quality assurance, safety, training, and compliance, subject to applicable law and campaign configuration. A communication may identify that it uses AI or automation and may provide recording, monitoring, identity, or opt-out disclosures.
If you do not want further calls or messages from a DialWorks-operated campaign, follow the opt-out instructions in the communication, say that you want calls or messages to stop, reply STOP where supported, or contact us at support@dialworks.ai or (480) 269-7844 with the telephone number or address to suppress. We may ask for limited information needed to identify the record. An opt-out from one customer or campaign may not automatically apply to a different organization that independently obtained your information, but DialWorks may use broader suppression controls where appropriate.
7. How We Disclose Personal Information
We may disclose personal information to the following categories of recipients for the purposes described in this Policy:
- Customers and authorized users. We provide campaign interactions, appointments, recordings, transcriptions, summaries, contact updates, opt-outs, and related information to the customer responsible for the campaign and its authorized users.
- Service providers and subprocessors. We use providers for telecommunications, AI voice and transcription, cloud hosting, data storage, CRM and calendar connectivity, email and SMS, analytics, payments, support, identity, monitoring, security, professional services, and related operations. They may process information under contractual and legal restrictions appropriate to their role.
- Customer-directed integrations and recipients. We disclose information to systems, providers, partners, and recipients a customer authorizes or directs us to use.
- Professional advisers. We may disclose information to attorneys, accountants, auditors, insurers, consultants, financing sources, and other advisers subject to appropriate duties.
- Legal, compliance, and safety recipients. We may disclose information to regulators, courts, law enforcement, litigants, carriers, providers, or others when we reasonably believe disclosure is required by law or necessary to protect rights, safety, systems, users, DialWorks, customers, or the public.
- Corporate transaction recipients. Information may be disclosed in connection with financing, due diligence, reorganization, merger, acquisition, investment, sale of assets or equity, or a similar transaction, subject to appropriate confidentiality protections where feasible.
- Other recipients with direction or consent. We may disclose information as otherwise disclosed at collection or with authorization.
8. Sale, Sharing, Targeted Advertising, and Analytics
DialWorks does not sell Customer Data or campaign contact information for money, and we do not use Customer Data for cross-context behavioral advertising. We may use website analytics, cookies, or similar technologies to understand website use, secure the site, remember preferences, and improve marketing. Depending on the technologies used and applicable state law, certain website advertising or analytics disclosures may be considered a “sale,” “sharing,” or targeted advertising even when no money is exchanged.
As of the Effective Date, DialWorks does not knowingly sell or share personal information as those terms are defined by the California Consumer Privacy Act for cross-context behavioral advertising. If our practices change, we will update this Policy and provide legally required opt-out methods before applying the changed practice. We do not knowingly sell or share personal information of individuals under sixteen years of age.
9. Cookies and Similar Technologies
Our website and providers may use cookies, pixels, local storage, and similar technologies. These technologies may be:
- Strictly necessary, for security, authentication, network management, and requested functionality;
- Functional, to remember settings and preferences;
- Analytics, to understand traffic, usage, errors, and performance; or
- Advertising or marketing, if implemented, to measure campaigns or provide relevant business advertising.
Browser settings may allow you to block or delete cookies, but doing so may affect functionality. Where required, we will provide a consent or preference mechanism and recognize legally required browser-based opt-out signals, such as Global Privacy Control, for the browser and device sending the signal. This Policy must be updated if DialWorks materially changes the website technologies it actually deploys.
10. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, customer instructions, and our legal and business obligations. Retention depends on the type of information, campaign configuration, customer relationship, sensitivity, operational need, contractual requirements, backup cycles, legal holds, disputes, limitation periods, provider requirements, and applicable law.
Customer account, contract, billing, acceptance, suppression, complaint, security, and compliance records may be retained after the customer relationship ends when reasonably necessary to document transactions, honor opt-outs, prevent prohibited contact, resolve disputes, comply with law, or protect legal rights. Recordings, transcripts, appointment records, and Customer Data may have different retention periods based on customer configuration and applicable agreements. Deidentified information may be retained where it cannot reasonably be used to identify an individual.
11. Data Security
We maintain administrative, technical, and organizational safeguards designed to protect personal information in light of its nature, the Services, and reasonably foreseeable risks. These measures may include access controls, authentication, encryption in transit, logging, monitoring, environment separation, provider management, backups, incident response, and personnel or contractor restrictions, as appropriate.
No internet transmission, telecommunications system, storage platform, AI provider, integration, or security measure is completely secure. We cannot guarantee absolute security. Customers and users are responsible for protecting credentials, devices, permissions, integrations, and information within their control and should promptly report suspected unauthorized access to support@dialworks.ai or (480) 269-7844.
12. Children’s Privacy
The website and Services are intended for business use and are not directed to children under thirteen. We do not knowingly collect personal information online from children under thirteen. If we learn that such information was collected through our own website or account without legally sufficient authorization, we will take appropriate steps to delete or otherwise address it. Customers may not use the Services to target children or submit children’s personal information without DialWorks’ prior written approval and all legally required permissions.
13. Privacy Rights and Requests
Depending on your jurisdiction and our role, you may have rights to request access, confirmation, correction, deletion, or a portable copy of personal information; obtain information about categories, sources, purposes, and recipients; opt out of sale, sharing, targeted advertising, or certain profiling; limit certain uses of sensitive personal information; withdraw consent; or appeal a denied request.

Describe your relationship with DialWorks and the information or campaign involved. We may verify your identity and authority using information reasonably related to the request. An authorized agent may submit a request where permitted, subject to verification of the agent’s authority and the individual’s identity.
If DialWorks processes the information solely for a customer, we may identify or refer the request to that customer and assist it as required by contract or law. DialWorks cannot delete information controlled by a customer from the customer’s independent systems, public sources, or another provider. We may deny or limit a request when an exception applies, including inability to verify, legal retention, security, fraud prevention, privileged information, or another lawful basis. Where required, our response will explain how to appeal.
We will not unlawfully discriminate against an individual for exercising applicable privacy rights. We may retain a suppression record after a deletion request when necessary to honor a do-not-contact request and prevent future communications.
14. California and Other U.S. State Disclosures
For residents of states with applicable comprehensive privacy laws, the categories of personal information collected are described in Section 2; sources in Section 3; business and commercial purposes in Section 4; and categories of recipients in Section 7. We may collect identifiers, professional information, commercial or transaction records, internet or electronic activity, audio or communications information, approximate geolocation, inferences, and other information submitted in connection with the Services.
We do not use or disclose sensitive personal information for purposes that require a right to limit under California law, unless this Policy or a notice at collection states otherwise. We do not offer financial incentives for personal information. DialWorks will provide any legally required notice at collection, state-specific supplement, appeal method, or opt-out mechanism when a law applies to DialWorks and the relevant processing.
15. Business Communications
We may send customers, users, and business contacts service, account, billing, security, support, and legal communications. These transactional communications are not marketing opt-ins and may continue while an account or legal obligation remains. Recipients of promotional email may unsubscribe using the link provided or by contacting us. Unsubscribing from marketing does not stop necessary transactional communications or customer-directed campaign communications governed by a separate relationship.
16. Third-Party Services and Links
The Services may connect to customer-selected CRMs, calendars, telecommunications providers, payment services, websites, and other third-party products. Those third parties may independently collect or use information under their own privacy notices and agreements. DialWorks is not responsible for a third party’s independent privacy or security practices. Customers should review the terms and permissions of each integration they authorize.
17. United States Processing
DialWorks is based in the United States and the Services are presently intended primarily for United States business operations. Personal information may be processed and stored in the United States and other locations where our providers operate. If a customer requests international processing or communications, additional written privacy, transfer, and compliance terms may be required before launch.
18. Changes to This Policy
We may update this Policy to reflect changes in the Services, technology, providers, law, or our practices. We will post the updated Policy with a revised effective date and provide additional notice or request reacceptance when required. Material changes will not be applied retroactively in a manner inconsistent with law or applicable customer agreements. We will maintain prior versions as appropriate for contract and compliance records.
